Changes to Employment Law and Minimum Wage
2017 will see changes to Jersey's minimum wage law and the Employment (Jersey) Law 2003 coming into effect.
MINIMUM WAGE: From 1 April 2017 the standard hourly minimum wage rate will increase from the current rate of £6.97/hour to £7.18/hour, a 3% increase.
AMENDMENT NO. 10 to the Employment (Jersey) Law 2003 covers a range of matters, including additional employment protection for Armed Forces Reservists and the removal of the short unfair dismissal qualifying period for people on fixed term contracts (removal of the "two-thirds rule").
TRIBUNAL: Amendment No. 10 also increases the powers of the Tribunal. From 1 April 2017 the Tribunal will be able to order payment of compensation to employees where an employer has failed to comply with statutory obligations in relation to:
(i) the provision of compliant written statements of employment terms;
(ii) rest breaks; and
(iii) the provision of pay slips.
In each of these cases an employer can be ordered to pay an employee up to 4 weeks' pay. This is in addition to the existing powers of the Tribunal.
